Would Say's Phoebe be too large for this bird? The belly is a bit yellow
for that, but I don't know how seawater affected it or how accurate the
colors are on the image. I haven't read all the responses, so don't know
what has been eliminated.

In response to David and Mike, between the bird's small size, relatively
large bill, and the rufous underwing coverts I believe this eliminates any
Empidonax mentioned. As for origin I wouldn't rule out a stray from Central
or South America, which is why I strongly encourage the specimen be
salvaged.
I saw that Mike Patterson posted this to ID Frontiers so perhaps some
feedback will come from there. I am also forwarding this to a number of
experts here and there.

Max Smith sent me photos of a bird found while doing a COASST
mile beached bird survey yesterday.

It looks to be an Empidonax flycatcher, my best guess "Western"
Flycatcher, but I suppose we should consider European or
Neotropical stray (outside Empidonax?) as well....
